1. Acceptance of Terms
By accessing or using the website located at https://www.1upgametruck.com, you agree to comply with and be bound by these Terms and Conditions and all applicable federal, state, and local laws and regulations.
If you do not agree with any part of these Terms and Conditions, you must not use this website or book services through it.
These Terms apply to all visitors, customers, and users of the website and services provided by 1-Up Game Truck.
All materials contained on this website are protected by applicable copyright, trademark, and intellectual property laws.
2. Intellectual Property and Website Use
All website content including text, graphics, logos, images, videos, designs, and software are the property of 1-Up Game Truck or its licensors.
You may access and view website materials for personal, non-commercial use only.
You may not:
• modify or copy website materials
• use website content for commercial purposes without written permission
• remove copyright or proprietary notices
• attempt to reverse engineer or access underlying code
• mirror or redistribute website content on other platforms or servers
Unauthorized use may result in termination of access and potential legal action.
3. Service Description
1-Up Game Truck provides mobile video gaming entertainment services for private parties, birthdays, school events, corporate functions, community events, and other gatherings.
Service availability, pricing, packages, and service areas may change without notice.
Booking a service constitutes acceptance of these Terms and Conditions.
4. Booking and Payment Policy
All private events require full payment at the time of booking in order to secure the event date and time.
1-Up Game Truck does not accept deposits for private event bookings.
Payments are processed through secure third-party payment processors.
Failure to complete payment will result in the event time not being reserved.
5. Travel Fees and Secondary Service Area Surcharges
Certain event locations require a secondary service area travel surcharge based on distance from our base of operations.
Customers are responsible for selecting the appropriate travel surcharge option during booking.
If the appropriate surcharge is not selected at the time of booking, 1-Up Game Truck reserves the right to charge the payment method on file on the day of the event unless other payment arrangements have been made in advance.
6. Cancellation and Rescheduling Policy
We understand that sometimes circumstances arise and events may need to be canceled or rescheduled.
Full Refund
A full refund will be provided when at least fourteen (14) days notice is provided prior to the scheduled event date.
Cancellation requests must be submitted via email to:
Cancellations Less Than 14 Days
Cancellations with less than fourteen (14) days notice will forfeit $50 of the total booking cost, unless the event is rescheduled.
Events may be rescheduled within six (6) months of the original event date.
Events may only be rescheduled one time.
Cancellations Within 7 Days
Cancellations occurring within seven (7) days of the event are at the sole discretion of 1-Up Game Truck and may result in forfeiture of up to 100% of the total event cost, unless the event is rescheduled within six (6) months.
Events may only be rescheduled once.
Illness or Unexpected Circumstances
We understand that life happens and the host or guest of honor may become ill shortly before the event.
If this occurs, please contact us as soon as possible to discuss your specific situation.

7. Chargebacks and Payment Disputes
By booking an event and agreeing to these Terms and Conditions, the customer acknowledges and agrees to the stated payment, cancellation, and refund policies.
Customers agree not to initiate credit card chargebacks or payment disputes for services rendered or for cancellations handled according to these Terms.
In the event of a chargeback or payment dispute that violates these Terms, 1-Up Game Truck reserves the right to:
• provide these Terms and booking records to the payment processor
• recover any disputed amounts owed
• pursue recovery of administrative costs and legal expenses where permitted by law
8. Event Host Responsibilities
The person booking the event (“Event Host”) is responsible for:
• ensuring safe and legal parking for the gaming vehicle
• providing a suitable event location
• supervising participants, particularly minors
• remaining present or designating a responsible adult during the event
• ensuring participants follow staff instructions
1-Up Game Truck staff operate the gaming equipment but do not assume responsibility for supervising children or participants.
9. Parking, Access, and Setup Requirements
The Event Host must ensure the event location provides safe and adequate access for the gaming vehicle and trailer where applicable.
The required parking space must be clear and accessible upon arrival.
If vehicles, obstacles, or other conditions prevent the game truck from safely parking or operating, 1-Up Game Truck reserves the right to delay, relocate, shorten, or cancel the event.
Event time will not be extended for delays caused by parking or access issues.
If the event cannot proceed due to inaccessible or unsafe parking conditions, the event may be considered completed for scheduling purposes and no refund may be issued.
Customers are responsible for obtaining any required permits, permissions, or local approvals.
1-Up Game Truck assumes no liability for issues arising from failure to obtain necessary permits.
10. Equipment Care and Property Responsibility
Participants must treat all gaming equipment with care.
The Event Host may be held financially responsible for damage caused by negligence, misuse, or intentional misconduct.
11. Participant Conduct and Safety
Participants must follow all instructions provided by 1-Up Game Truck staff.
Unsafe behavior or misuse of equipment may result in:
• removal of participants
• suspension of activities
• termination of the event
12. Weather Policy
Certain weather conditions may prevent safe operation of the gaming vehicle.
Events may be delayed, relocated, or rescheduled due to severe weather or unsafe conditions.
Lawn game add-ons will be refunded in cases of inclement weather.
13. Technical Issues
Technical issues may occasionally occur including hardware malfunction, software issues, or internet interruptions.
1-Up Game Truck will make reasonable efforts to resolve issues but does not guarantee uninterrupted operation of all games or equipment.
14. Booking Confirmation Emails
After booking, customers will receive three emails:
- Bookeo – booking information
- Stripe – payment confirmation
- travis.coleman@1upgametruck.com – booking follow-up or final confirmation
Customers should check their inbox and spam folder.
15. Pennsylvania Event Policies
All Pennsylvania events are subject to:
• a minimum $25 travel surcharge
• proper travel surcharge selection during booking
Until 1-Up Game Truck meets Pennsylvania Sales Tax Economic Nexus requirements, any New Jersey sales tax charged on Pennsylvania bookings will be refunded after booking.
16. Media Release
Events may occasionally be photographed or recorded for marketing purposes including:
• social media
• website content
• promotional materials
Participants grant permission for such use unless the Event Host requests otherwise before the event.
17. Third Party Links
The website may contain links to third-party websites which are not controlled by 1-Up Game Truck.
18. Disclaimer of Warranties
The website and services are provided on an “as is” and “as available” basis.
19. Limitation of Liability
1-Up Game Truck shall not be liable for indirect, incidental, or consequential damages arising from the use of services or the website, to the fullest extent permitted by law.
20. Indemnification
Customers agree to indemnify and hold harmless 1-Up Game Truck and its owners, employees, and affiliates from claims or damages resulting from use of services or violation of these Terms.
21. Dispute Resolution
In the event of a dispute arising from these Terms or from services provided by 1-Up Game Truck, the parties agree to first attempt to resolve the dispute through good faith negotiation.
If the dispute cannot be resolved informally, the parties agree to attempt mediation with a mutually agreed mediator located in New Jersey before pursuing formal legal action.
Nothing in this section prevents either party from seeking relief in a court of competent jurisdiction if mediation is unsuccessful.
22. Modifications to Terms
1-Up Game Truck reserves the right to modify these Terms and Conditions at any time.
Updated terms become effective immediately upon posting to the website.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
24. Governing Law
These Terms and Conditions are governed by the laws of the State of New Jersey.
Any legal action arising from these Terms shall be brought in the courts located within New Jersey.
